The inventor presented the garment on Saturday, Sep. 25, 2021 at Rhode Island Fashion Week for her brand, Hiba Aswad. Attendees purchased tickets in order to attend in person or virtually. The medical purpose of this garment was not disclosed, therefore the use and purpose of the utility elements in the garment construction were not disclosed. The inventor did not sign a photo release for the fashion show, thus prohibiting the production company and everyone involved in the show from sharing and posting images/videos of the garments. The inventor has not publicly disclosed the medical utility.
The Inventor participated Pure London, a fashion industry trade show from Feb. 12-14, 2023, after the PPAS were filed. The medical purpose of this garment was not disclosed, therefore the use and purpose of the utility elements in the garment construction were not disclosed to visitors at the trade shows, nor to buyers. The Inventor requested that no photographs be taken at her booth, and by the event photographers. The Inventor listed the garment as patent pending without disclosing what the patent was for.
Fashion design
The inventor could not find related art to the search “clothes for scoliosis” that aligned with what these garments achieve, which is clothes that are comfortable to wear for a person with scoliosis. The only related searches found were that of a medical, therapeutic treatment nature. Examples include tops and bras that have sensors to alert a patient to adjust their posture, as well as back braces.
The Red Tide Raglan Pullover, along with other garments she has designed, is specifically designed to accommodate scoliosis and/or other spinal conditions. Most garments are not designed with these differences in mind, and can add to the pain of a person living with this or other conditions. Oftentimes, a person living with scoliosis and/or chronic back pain are limited to wearing athleisure and sports clothes, which can impact the way a person views themselves. Sometimes, even those garments are painful. The fashion industry as a whole does not design for persons with scoliosis, or other disabilities, and there is little representation for these groups.
The Red Tide Raglan Pullover is designed to enable freedom of movement and mobility for people with scoliosis and/or other spinal conditions. People with scoliosis can be limited in finding garments that they can wear comfortably and freely, without being inhibited or without pain. The features and construction of this sweater are designed specifically to allow a person full range of movement, no matter the activity or reason for wear.
The combination of raglan sleeves with armpit gussets, darts at the shoulders, a wide and long body, wide sleeves, open vents at the sides, ribbed bands at the sleeve cuffs and hem, and a widened neck hole give a full range of mobility for the wearer. Due to patients with scoliosis having asymmetry of the spine, the ribcage, the shoulders, neck, hips, and legs, it can be difficult for a garment to be comfortable, as it can obstruct the movement of the patient, and get caught on the asymmetries.
For full rib cage and thoracic spine and torso mobility, a square, knit gusset has been inserted at the armpits in order to ensure a full range of rotation, mobility and expansion at the shoulders without restricting the shoulders, upper back, chest and rib cage. Raglan sleeves are traditionally used as a sleeve design for mobility in jackets, coats, shirts, sweaters, and dresses. However, though they have more mobility than a regular capped sleeve, they still can be restrictive, which is why the addition of the gusset is essential. These raglan sleeves are additionally constructed with extra ease/room, and darts at the the shoulder seam to give more movement and structure so that a person can wear it more easily with varying shirt widths underneath. The sleeve length is ¾ the length of the arm, to remove extra restriction that can sometimes occur with long-sleeve sweaters. Additionally, the armhole is slightly larger than a typical sweater, to give more room.
The sweater has two vents at the hip levels to give mobility for the low back. This enables a person with scoliosis to wear a shirt comfortably without pain, restriction or obstruction, while other sweaters may give mobility but not enough for someone with an asymmetrical spine.
The length and the width of the sweater give more room for a person with scoliosis, since scoliosis creates asymmetries in the torso and body. This gives more room and material that moves and expands with the wearer's body, without restricting it. These elements help give the most material constructed in a way that give full mobility, while also not compromising the design.
A wide, ribbed neck hole helps remove restrictions for neck mobility, especially when the sweater is layered over a shirt. It also eases movement for the shoulders, rib cage, and upper back and upper chest. There is also ribbing at the sleeve cuffs and the hem to give more room, and expand according to the body of the wearer.
Red Tide Raglan Pullover is made with a lightweight merino wool to ensure that the wearer doesn't have pain while wearing the shirt. This gives thermal properties to the sweater while not weighing down on the wearer's body. Thick sweaters are painful to wear for people with scoliosis and/or back pain due to the weight of the material. Additionally, the bulkiness of the wool used, in conjunction with the sweater design and construction, can restrict the movement of the wearer. Extra weight bears down on the spinal curvature and structure, which can be painful and contribute to exacerbation of the curvature and pain symptoms.
The Red Tide Raglan Pullover (No. 63/443,441), Onde Pleated Skirt (Ser. No. 18/475,190), The Shield Raincoat (Ser. No. 18/475,178), Mauj Pleated Dress (No. 63/443,439), and Wave Sleeveless Top (Ser. No. 18/475,187) are all utility patient applications submitted by the inventor, Hiba Aswald, under her fashion brand, Hiba Aswad. The brand produces garments that are comfortable to wear for people with scoliosis, and/or other spinal conditions, and uses some of the same specific design elements in each garment submitted. The inventor will be submitting more related applications in the future as she designs new garments.
