- 1. An isolated nucleic acid comprising SEQ ID NO:1.

An isolated nucleic acid comprising a sequence selected from the group consisting of SEQ ID NO:2, SEQ ID NO:3, SEQ ID NO:4, SEQ ID NO:5, SEQ ID NO:6, SEQ ID NO:7, SEQ ID NO:8, SEQ ID NO:9, SEQ ID NO:10, SEQ ID NO:11, SEQ ID NO:12, SEQ ID NO:13, SEQ ID NO:14. - 3. A nucleic acid construct comprising SEQ ID NO:1, operably linked to a heterologous protein coding sequence.

- 8. The construct of claim 7 wherein the promoter is operable linked to a reporter gene.
- 9. The construct of claim 7 or 8 wherein the promoter is selected from the group consisting of SV40, CMV or TK.
- 10. The construct of claim 8 or 9 wherein the reporter gene is selected from the group consisting of luciferase, CAT, secreted alkaline phosphatase, green fluorescent protein, or human growth hormone.
- 11. A nucleic acid construct comprising at least one cytoprotective response element that induces the expression of microsomal epoxide hydroxylase.
- 12. The construct of claim 11, wherein the cytoprotective response element is selected from the group consisting of SEQ ID NO:1. SEQ ID NO:2, SEQ ID NO:3, SEQ ID NO:4, SEQ ID NO:5, SEQ ID NO:6, SEQ ID NO:7, SEQ ID NO:8, SEQ ID NO:9, SEQ ID NO:10, SEQ ID NO:11, SEQ ID NO:12, SEQ ID NO:13, SEQ ID NO:14. SEQ ID NO:15, SEQ ID NO:16, SEQ ID NO:17, SEQ ID NO:18, SEQ ID NO:19, SEQ ID NO:20; SEQ ID NO:21; SEQ ID NO:22.
- 13. A isolated nucleic acid construct comprising three cytoprotective response elements.
- 14. The nucleic acid construct of claim 14 wherein the three cytoprotective response elements comprise SEQ. ID. NO. 2, SEQ. ID. NO.21 or SEQ. ID. NO.22.
- 15. The nucleic acid construct of claim 13 or 14 wherein the cytoprotective response elements are selected from the group consisting of SEQ ID NO:1. SEQ ID NO:3, SEQ ID NO:4, SEQ ID NO:5, SEQ ID NO:6, SEQ ID NO:7, SEQ ID NO:8, SEQ ID NO:9, SEQ ID NO:10, SEQ ID NO:11, SEQ ID NO:12, SEQ ID NO:13, SEQ ID NO:14. SEQ ID NO:15, SEQ ID NO:16, SEQ ID NO:17, SEQ ID NO:18, SEQ ID NO:19, and SEQ ID NO:20.
- 16. The construct of claims 13, 14 or 15 wherein the cytoprotective response element is operably linked to a promoter.
- 17. The construct of claim 16 wherein the promoter is operably linked to a reporter gene.
- 18. The construct of claim 16 or 17 wherein the promoter is selected from the group consisting of SV40, CMV or TK.
- 19. The construct of claim 17 or 18 wherein the reporter gene is selected from the group consisting of luciferase, CAT, secreted alkaline phosphatase, green fluorescent protein, or human growth hormone.
- 20. A method of identifying a compound that increases transcription of an mRNA regulated by a cytoprotective response element, the method comprising:
(a) assaying a first cellular extract for the amount of product from transcription of said mRNA, wherein said mRNA is expressed from a DNA construct, said transcription being in the absence of a candidate compound and said DNA construct comprising a cytoprotective response element of SEQ ID NO:1, operably linked to a protein coding sequence; (b) assaying a second cellular extract for the amount of product from transcription of said mRNA, wherein said mRNA is expressed from said DNA construct, said transcription being in the presence of said candidate compound; and (c) comparing the amounts of products from transcription of said first extract and said second extract, wherein a greater amount of product from transcription in said second extract as compared to said first extract indicates that said candidate compound increases transcription of said mRNA regulated by said cytoprotective response element.
- 21. A method of identifying a compound that increases transcription of an mRNA regulated by a cytoprotective response element, the method comprising:
(a) assaying a first cellular extract for the amount of product from transcription of said mRNA, wherein said mRNA is expressed from a DNA construct, said transcription being in the absence of a candidate compound and said DNA construct comprising a cytoprotective response element of a sequence selected from the group consisting of SEQ ID NO:2, SEQ ID NO:3, SEQ ID NO:4, SEQ ID NO:5, SEQ ID NO:6, SEQ ID NO:7, SEQ ID NO:8, SEQ ID NO:9, SEQ ID NO:10, SEQ ID NO:11, SEQ ID NO:12, SEQ ID NO:13, SEQ ID NO:14. SEQ ID NO:15, SEQ ID NO:16, SEQ ID NO:17, SEQ ID NO:18, SEQ ID NO:19, and SEQ ID NO:20; operably linked to a protein coding sequence; (b) assaying a second cellular extract for the amount of product from transcription of said mRNA, wherein said mRNA is expressed from said DNA construct, said transcription being in the presence of said candidate compound; and (c) comparing the amounts of products from transcription of said first extract and said second extract, wherein a greater amount of product from transcription in said second extract as compared to said first extract indicates that said candidate compound increases transcription of said mRNA regulated by said cytoprotective response element.
- 22. The method of claim 21, wherein said cytoprotective response element is SEQ ID NO:3.
- 23. The method of claims 20, 21 or 22, wherein said protein coding sequence is a reporter gene.
- 24. The method of claims 20, 21 or 22, wherein said product from transcription is a protein.
- 25. The method of claim 24, wherein said reporter gene is selected from the group consisting of luciferase, CAT, secreted alkaline phosphatase, green fluorescent protein, or human growth hormone.
- 26. The method of claims 20, 21 or 22 wherein said first cellular extract and said second cellular extract is derived from HMEC or HeLa cell lines.
- 27. The method of claims 20, 21 or 22 wherein the compound is an anti-inflammatory compound.
- 28. The compound of claims 20, 21 or 22 wherein the compound is an antiproliferative compound.
- 29. The compound of claims 20, 21 or 22 wherein the compound is a general cytoprotective agent.
