This section is not Applicable to Provisional Applications. However, as far as known, there are no special outdoor game that combines corn hole, bocce ball, and horseshoes as a beach game or the like. It is believed that this product is unique in its design and technologies. This background as to beach games and backyard informal games of tossing objects should be useful.
Playing sports along beaches, yards, and fields is a popular recreational pastime which has the advantage of promoting good health through outdoor exercise. Common beach games include Volleyball, Football, Soccer, Baseball, Bocce Ball, and Frisbee. Although these activities are excellent forms of exercise for children and young adults, they may not necessarily be suitable for all ages. This is especially true for in the case of high intensity sports such as Volleyball, Football, and Soccer. It is also true in the case of Bocce Ball, which requires the participant to throw very heavy balls considerable distances.
Target games are well known in the art. The target game art generally consists of rolling, tossing, or shooting various projectiles toward a target. The target itself usually consists of either various numbered rings or other scoring indicators, or of various pins or other objects which are knocked down. Several pitching and tossing games have been developed over the years, including such classics as horseshoes, quoits, and similar games. Generally speaking, such games involve the placement of two targets at some distance apart, with players attempting to toss one or more objects from the location of one target, to the opposite target. Such games nearly universally involve the installation of a pair of stakes or the like to serve as the targets for the game.
Beach games are very popular amongst children and adults. Existing games can be fun but tend to become tedious or boring after time. Paddleball is a popular game using wooden paddles and a small rubber ball. Players simply bat the ball back and forth, typically without any competition, scoring, etc. Low skill levels or low coordination can also be burdensome as players are constantly chasing missed balls or misdirected balls. Bocce ball is also a popular game played with a small (target) ball and several larger balls. Once the target cup and stake are placed, players take turns pitching the golf balls, and points are scored based on the proximity of the balls to the cup or target stakes. This game adds a competitive element, but it is sometimes difficult to determine whose ball is closest to the target stake and needs to be measured for comparison.
Problem Solved
The improvement and problem solved by this special outdoor game that combines corn hole, bocce ball, and horseshoes as a beach game are many. The game:
As far as known, there are no devices for a special outdoor game that combines corn hole, bocce ball, and horseshoes as a beach game as described by Weston et al. It is believed that this product is unique in its design and technologies. A novelty search revealed:
A. U.S. Pat. No. 3,948,521 by Warren was issued in 1976 and named Ball game and apparatus. It shows a ball game involving from three to 24 players including a marked playing surface, a single batter's post with soft-ball size target ball on top, a bat (may have a resilient sleeve) for the batter stationed near the batter's post, and a larger ball, hollow, rubber, about 8 inches in diameter, for use by players in attempting to topple the target ball off of the batter's post to retire the batter.
B. U.S. Pat. No. 5,476,260 by Ottley was issued in 1995 and called a Target game. It teaches a target game for outdoor use wherein a ball is tossed or rolled toward a target with the target comprising a plurality of cups which are buried in the ground. Additionally, a backer board and rails are provided to accurately guide the ball in its path.
C. U.S. Pat. No. 6,884,178 by Frost was issued in 2005 for an invention called a Kit and method for playing a golf-like game. Yhis demonstrated kits and methods for playing a golf-like game provide golfers with a fun and challenging alternative to conventional golf. A kit comprising three T-joints, three tubes, three poles, three flags, a mat of artificial turf, a marker, and six plastic golf balls is disclosed. The opposing ends of the tubes are inserted into the opposing ends of the T-joints to form rings, and the flags are attached by the poles to the middle of the T-joints. Each of the flags has a different color, with one flag being red, one being yellow, and one being blue. Various methods of play using the kit and standard commercially available golf clubs are disclosed, including horseshoes, traditional golf, and “Golf 500.”
D. U.S. Pat. No. 7,338,047 by Kelley et al., was issued in 2008 for an idea described as a Ball pitching game and method. The present invention discloses a bowling/pitching game that can be played virtually anywhere a substantially flat surface can be found and is enjoyable for adults as well as children. The playing field includes a distance marker and a scoring goal comprised of an outer scoring area and an inner scoring area. The goal also includes a game pole called the OOnagi.TM. pole and an object ball called an OOnagi.TM.ball, which sits on top of the OOnagi.TM. pole. While standing at the distance marker, the players pitch or bowl their balls called chuckers at the scoring goal. Scores are calculated according to the placement of the chuckers and OOnagi.TM. ball in the scoring goal.
E. U.S. Pat. No. 9,526,962 by Kegal was issued in 2016 for a device called a Ball tossing game formation kit. It taught a ball tossing game formation kit includes a digging tool for forming a semi-spherical hole in a surface of sand. The digging tool comprises a plate having a first side. The perimeter edge includes a bottom edge, a top edge, a first side edge and a second side edge. The bottom edge is convexly arcuate from the first side edge to the second side edge. A depth line is defined extending between a juncture of the first side edge and the bottom edge and a juncture of the second side edge and the bottom edge. The bottom edge includes a distal edge with respect to the depth line. A distance from a center of the depth line to the distal edge is greater than 4.0 inches and less than 6.0 inches. A barrier mold is filled with sand and overturned to form the sand into a backstop.
F. US Publication 2004/0108652 by Vaden submitted in 2004 was named a Tossing game. It taught a tossing game includes a pair of open-ended target receptacles, which are buried in the ground at some predetermined distance apart from one another with their upper rims flush with the surface. A series of relatively small tossing objects are provided to the players, who attempt to toss the objects into one target receptacle while standing just back of the opposite target receptacle. The targets may comprise relatively large diameter electrical metal tubing, polyvinyl chloride pipe, or other suitable material as desired. The tossing objects may comprise a series of relatively large diameter steel washers, or other suitable objects as desired. Preferably, the tossing objects are differentiated in some manner, into sets used by the different players. Scoring is according to the accuracy of each toss, with a cancellation system being used for like tosses by opposing players.
G. US Publication 2004/0166965 by Hiatt was submitted in 2004 and called a Pitch and putt lawn golf. Demonstrated is a pitch and putt lawn golf game that may be played by persons of all ages, golfers, and non-golfers alike, and includes a series of hole markers and a golf ball, a putter, and a wedge for every player playing the game. Alternatively, the game may also include a set of irons in place of or in addition to the wedge, and/or a scorecard and pencil or other marking device. To play the game, a golf ball is pitched and putted through a series of hoops, just as a series of holes is played at a golf course. There are many benefits of the game: ease of play; teaching the rudimentary skills of golf; refining a player's short game skills; short time required to play a “round”; the ability to be used on virtually any lawn; flexible course layout; challenge; portability; requires no holes to be cut in the lawn; and the ease of setting the game up and taking the game down.
H. US Publication 2013/0017897 by Tsiopanas et al. was submitted in 2013 for a device named a Beach Golf Hand Ball. This application showed a beach golf game includes at least one rigid cup and a plurality of balls each sized to fit in the rigid cup. A rules sheet sets forth game rules and describes game play. The rigid cup and the balls are encased in a carrying bag. In playing the game, the cup is used to dig a hole in a sandy surface, and the cup is placed in the hole such that a top of the cup is level with the sandy surface. A mound of sand is built on one side of the cup, and players take turns attempting to roll the balls into the cup.
I. US Publication 2014/016908 by Johnson et al. was submitted in 2014 for a BALL TOSSING GAME AND METHODS OF PLAY. This presented an invention that relates to games and methods of playing the games, as well as kits for playing such games, and more particularly to ball toss games played on a playing field surface, by way of non-limiting example on a surface such as a turf field, tennis court, sand field, or sand beach, for example.
As can be observed, none of the prior art has anticipated or caused one skilled in the art of informal games of tossing objects for sport and recreation to reason, consider, or conclude this invention by Weston et al. as obvious to a person skilled in the ordinary art of the industry. The kit for a special outdoor game that combines corn hole, bocce ball, and horseshoes as a beach game provides an answer to the problems that are shown above. The Weston invention addresses the shortfalls and solves them, unlike previous art in this industry.
